In 2022, electric car sales accounted for 12% of total car sales in the European Union (EU) and increased by 28% compared to the previous year. Special mention for Norway, where the share of electric cars peaks at 79%. It must be said that this Scandinavian country is aiming for the end of combustion engines for new registrations from 2025, ten years before the date planned for the whole of the EU. The fact remains that to equip yourself with an electric or plug-in hybrid vehicle, you must be able to recharge it. Currently, 90% of electric car users charge it at home. However, not everyone has private parking, far from it. In 2019, a study entitled “Analysis of electric vehicle charging infrastructure”, carried out at the joint request of the Ministries of Economy and Ecological Transition, addressed in particular the central role of home charging. He pointed out that more than 12 million households do not have access to parking or a private charging device.
1-A right to take introduced since 2011
A first decree, promulgated on July 25, 2011, instituted for the first time a right to take, inspired by the right to the antenna. It provides for the obligation in apartment buildings with closed and covered parking to offer access to electricity allowing the installation of a charging station for electric or hybrid vehicles. However, the installation of the equipment itself remains the responsibility of the person who requests it. The charging station must be equipped with an individual meter. The right to take concerns both co-owners and tenants and applies whether you live in a condominium or a social housing building. The text first targeted buildings whose building permit date was after January 1, 2012, before affecting all existing residential buildings from 2015. This right of acquisition was reinforced by the decree of 24 December 2020. Indeed, it no longer only concerns covered car parks, but all private parking spaces, including those located outside, whether closed or not.
2-In co-ownership, informing the general meeting is mandatory
To exercise the right of taking, however, certain formalities must be fulfilled. The tenant must first notify his owner of his decision to carry out this work and provide a precise description by attaching a technical intervention plan and the connection diagram. If the owner is a legal person, contact his legal representative. The owner can only object to the work for a “serious and legitimate” reason – this may be because he has decided to carry out the work himself – and has fifteen days to respond. In a condominium, the lessor must send the request for the right to debit to the trustee, who has a period of three months to oppose it. The reason for refusal is mainly the installation of a collective charging solution. The request to install a charging station must be submitted to a general meeting. However, this is just information, it is not subject to a vote. If the general meeting is scheduled more than three months after the request to install a charging station, it is not necessary to wait for it to be held. General meetings have an obligation to put the issue of the collective charging solution on the agenda
3-Financial reminders
Various aids to the installation of a charging station exist. Launched in 2016, the Advenir program covers 50% of the cost of equipment, up to a limit of 960 euros for an individual charging station (8,000 euros for a collective installation), in condominiums and collective housing. Installation must be carried out by a licensed professional. Whether you live in an apartment building or a single-family house, you can benefit from a tax credit which represents 75% of the price of the installation (capped at 300 euros), without conditions of resources. This tax credit has been extended until December 31, 2023. You can also benefit from a 5.5% VAT reduction for the installation of a charging station, regardless of the date of construction of the building . Only condition to be entitled to this reduction: the qualification of the installer must be recognized. Local authorities have also set up aid for the installation of charging stations.
